​Terms and Conditions of the Campaign​​

“Double Your Benefits with KBank máyPOS”

These terms and conditions (the “Terms and Conditions”) govern the participation in Double Your Benefits with KBank máyPOS campaign of KASIKORNBANK PUBLIC COMPANY LIMITED - Ho Chi Minh City Branch (the “Bank”). By participating in the Campaign (as defined below) and receiving the Reward (as defined below) offered by the Bank, all participant are kindly required  to have carefully read, fully understood, and accepted the Terms and Conditions. 

The Terms and Conditions shall be effective from May 1st, 2024. 


1. Campaign​ :​ Double Your Benefits with KBank máyPOS campaign is sale promotion program conducted from time to time in accordance with these Terms and Conditions (the “Campaign”).

2. The Bank's promotion product​ : KBank máyPOS service provided by the Bank to supporting card payment acceptance for credit cards, and debit cards including local card scheme and international card scheme i.e. NAPAS, Visa, Mastercard, JCB and UnionPay. (“KBank máyPOS”).


 

3. Application Area : Ho Chi Minh City, Vietnam

4. Campagin period :​  The Campaign period will commence from 1 May 2024 to 30 June 2024 (both days inclusive) (the “Campaign Period”), unless otherwise terminated earlier in accordance with these Terms and Conditions.

5. Eligibility :
Subject to these Terms and Conditions, the Bank reserves the right to offer the Campaign and Reward (as defined below) only to the selected Bank’s new KBank máyPOS customer (hereinafter referred to as the “Eligible Customer”) who falls under all the following conditions:

 • Must be new customer to KBank máyPOS who successfully installed KBank máyPOS during the Campaign Period and have card transaction via KBank máyPOS with a minimum amount at 100,000 VND per transaction within a specified the Campaign Period.
 • Must have a merchant discount rate (MDR) of local card schemes VISA, MasterCard, JCB, Union Pay greater than or equal to 1.6% (excluding VAT) or have received notice about this Campaign from the Bank.
 • Must not be determined to have engaged in fraudulent transaction and/or his/her terminal must not be disabled or terminated or closed during the Campaign Period and before the crediting of the Reward. 

Remark: The Eligible Customer will be automatically registered to the Campaign and each merchant identification number (MID) is considered as 1 merchant.

The eligibility for the Campaign and Reward offer will be subject to the Bank’s sole and absolute discretion. 

6. Campaign Reward and Conditions :  The Reward under this Campaign is cashback reward valued up to 1,000,000 VND (referred to as the “Reward”) per each Eligible Customer throughout Campaign Period.

Eligible Customer will receive a cashback of 10.000 VND for every minimum amount of 100.000 VND per card payment transaction, maximum 500,000 VND per month for two (2) consecutive months after installation period. The Reward throughout the Campaign is capped at VND 1,000,000 per Eligible Customer per Campaign. 

Each selected Eligible Customer who meets eligibility criteria and complied with these Terms and Conditions will be eligible to receive a maximum of 1 (one) Reward per person under this Campaign, subject to the Bank's sole and absolute discretion.

  •  Conditions :

    •  Rewards are limited to first 2,000 (Two thousand) Eligible Customers only throughout the Campaign Period, on a first-come, first-served basis based on the installation and transaction period and subject to the availability for allocation of the Reward
  • •  Reward will be calculated from settlement daily transactions within Campaign Period. These amounts will be combined and calculate according to the schedule below.

    ​  Total maximum Reward of 1,000,000 VND per Eligible Customer throughout the Campaign.
    ​  Daily POS transaction amount is calculated by settlement transactions deduct refund/ dispute/ chargeback transactions. Also, the daily POS usage volume shall exclude transactions in the process of investigating suspicious transactions in violation of the provision of law and regulation; and exclude transactions determined by the Bank that showing signs of fraud, and/or taking advantage of the Campaign.
    •​​  Eligible Customer will be disqualified from receiving Reward due to the following events:
    •​​  Eligible Customer are verified and determined to have engaged in fraudulent transactions;
    •  
    KBank máyPOS service is terminated or disabled or closed during the Campaign Period and/or before the crediting of the Reward; and/or
    •  Failure to comply any terms and conditions contained in POS Service Agreement.
    •​​  The Bank will not be responsible in notifying the Eligible Customer should the Reward have reached the maximum capping of the Reward allocated.
    •​​  The Bank reserves the right to disqualify any Eligible Customer from further participation in this Campaign if such Eligible Customer has received the Reward exceeding capped amount during the Campaign Period or the Bank determine that such Eligible Customer may act in breach or potential breach of these Terms and Conditions.
    •​​  The Bank has the right at its discretion to approve or decline any application and is neither obliged to give any reason or prior notice on any matter concerning the application nor be liable to any party. The Bank has the right to withdraw Rewards in accordance with the Terms and Conditions of this Campaign by deducting money (debit) from the Eligible Customer’s bank account opened with the Bank or performing other forms to withdrawal without the customer's consent, in case the Bank detects invalid transactions or the card is closed or terminated before awarding Rewards (for any reason).

    •​​  Only expenditures in Vietnamese Dong (VND) qualify to receive the Reward.
    •​​  Eligible Customer shall examine the Reward upon the receipt. The Reward has not been certified by the Bank and under no circumstances shall the inclusion of the Reward in this campaign be construed as an endorsement or recommendation of such reward by the Bank. The Bank shall not be responsible nor be liable if the Eligible Customer is dissatisfied with the Reward, except for the Reward’s quality.
    •​​  Once the Reward is redeemed, it cannot be changed or canceled. The Bank reserves the right not to refund Reward under any circumstances.
    •​​  The Bank reserves the right to retain data of the usage transaction. Eligible Customer should keep campaign participation evidence and sales slip to track usage if necessary.

    The Bank reserves the right to restrict, debit, revoke, withdraw, cancel the usage of Reward and/or disqualify any Eligible Customer from participating the Campaign with immediate effect in the event that such Eligible Customer is found to have performed suspicious behavior, committed fraudulent, wrongful acts or illegal transactions, or provided invalid, incomplete or untrue details/credentials, or breached applicable rules, regulations or conditions set by the Bank.
    •​​  Any determination by the Bank as to whether any payment transaction qualifies as an eligible transaction under this Campaign and the decision of the Bank shall be conclusive, absolute and cannot be challenged in any manner whatsoever.

7. Total value of R​eward : The total value of the Reward for the whole Campaign Period shall not exceed VND 1,000,000,000 (in words: One Billion Vietnamese Dong). 

8. General terms and Conditions:​
• General terms and conditions for KBank máyPOS service (POS Service Agreement) will apply to customers participating in this Campaign. For more information, please visit https://www.kasikornbank.com.vn. 
• Customer hereby indemnify and hold the Bank harmless from any losses, liability, damage, or claims arising from or in connection with this Campaign as a result of Merchant’s action in violation of these Terms and Conditions and/or improper use of the Reward.
• The Reward is non-refundable, non-transferable, and not exchangeable for cash or any other benefits in kind. The Eligible Customer cannot transfer the Reward to any other person.

• The Bank reserves (i) the right to select the Eligible Customer apart from criteria listed in No.5 (ii) the right to reject the Eligible Customer’s request for any change of the Reward and (iii) the right to change or cancel all or any part of the Reward according to the Bank’s sole decision in compliance with the applicable laws.
• Awarding of Reward is subject to verification of the Eligible Customer’s eligibility and identity according to the Bank’s procedure. If the Bank at any time determines (at its sole and absolute discretion) that any of the eligibility requirements set out in these Terms and Conditions was not or has not been complied with but any Reward has been received by the Eligible Customer, the Bank reserves the right to immediately recover any and all Reward or the value of any or all Reward from such Eligible Customer.
• The Eligible Customer acknowledges and agrees that the delivery of Reward may be delayed in the event of force majeure and the Bank shall not be liable to any Eligible Customer for any damages in such circumstances. 
• 
The Bank shall not be responsible nor liable if the Eligible Customer’s contact details are not reachable or invalid.
• The Reward will not be replaced, and the Bank will not be liable in the event that the Reward is lost, damaged and/or stolen after the Eligible Customer receiving the Reward from the Bank.
​ The Campaign’s contents will be announced in the media of the Bank and other media channels (if any).
The Campaign shall not be applicable in conjunction with other promotions of the Bank. The Reward cannot be combined with any other promotions and rewards of other campaign of the Bank.
•  The Bank has the right at its own discretion to refuse giving or withdraw the Reward to any Eligible Customer that provides information, which is illicit, unclear, or incomplete, or violates these Terms and Conditions or any applicable law.
​ The Bank has the right to immediately suspend the participation in the Campaign, if a participant is not fully qualified or do not comply with regulations or conditions set by the Bank.
​ The Bank reserves (i) the right to immediately cancel and/or recover all or any of the Reward without giving prior notice to the Merchant and (ii) the right to claim for loss and damages from the Merchant if the Bank found that there is any fraudulent application/registration under this Campaign.
​ The Bank shall bear no responsibility for any damage, loss, liability incurred or suffered by any Eligible Customer and/or person in connection with this Campaign or the Reward to the extent permitted by laws.
The Bank may contact customer via phone number/ email registered with the Bank for further information, clarification or additional documents, if necessary.
​ The Reward shall be void where restricted or prohibited by law.
​ Eligible Customer agrees that the Bank may collect, process and use his/her personal image and information (including his/her personal data and personal data of other person that Eligible Customer provides to the Bank) for advertising and/or promotion purposes in a manner consistent with the Bank’s Privacy Policy, which may be accessible via

​ The Eligible Customer shall be responsible for any relevant taxes and fees (including but not limited to personal income tax), if applicable, as required by applicable laws, arising out of or relating to the receipt of Reward under this Campaign by the Eligible Customer. Any other costs and expenses which are not specifically included in these Terms and Conditions will be the sole responsibility of the Eligible Customer.
​ The terms and conditions governing the use of KBank máyPOS (POS Service Agreement or other names which is similar nature of usage and amend from time to time), deposit account and banking service related to the Campaign are applicable in conjunction with these Terms and Conditions. 
​ These Terms and Conditions shall be governed by and construed in accordance with the laws of Vietnam.
​ In case of dispute, the Bank’s decision and/or judgment on all matters will be final and binding.
The Bank reserves the right at its absolute discretion to terminate the Campaign at any time or amend, modify or supplement to any of these Terms and Conditions from time to time without prior notice, unless specified otherwise by applicable laws.

These Terms and Conditions are made in English and Vietnamese language. In case of any discrepancies or inconsistencies between the English language text and Vietnamese language text, the text that is more favorable to customers shall prevail.
